Appeal from an order of the Supreme Court (Spargo, J.), entered June 29, 2004 in Ulster County, which denied defendant’s motion for summary judgment dismissing the complaint.
Plaintiff Kristine Harris (hereinafter plaintiff) and her husband, derivatively, commenced this action to recover for injuries allegedly sustained by plaintiff as a result of falling on an icy sidewalk bordering defendant’s property in the Village of New Paltz, Ulster County.
