This case is before us on both a certificate from The Judge Advocate General of the Army and on a petition for review filed on behalf of the accused. Because the offense was committed prior to the effective date of the Uniform Code of Military Justice, 50 USC §§ 551-736, the accused was tried by a general court-martial at Taegu, Korea, *300upon charges of premeditated murder in violation of Article of War 92, 10 USC § 1564.
