September 2,1927, Frank O. Beaty was in the employ of defendant Foundation Company as a caisson worker, engaged in preparing footings for the Union Trust building in the city of Detroit. At the close of his work, at 4 o ’clock in the morning of that day, he went home, there vomited, lost his vision and the use of his legs, and died at 1:30 o’clock in the afternoon. The cause of his death was the caisson disease called “bends,” occasioned, usually, by too rapid decompression of air as the worker comes out of the caisson.
