John Crowley, Charles Kern and Richard T. Criche filed a complaint in the superior court of Cook county against the Elgin, Joliet and Eastern Railway Company under the Federal Employers’ Liability Act for occupational dermatitis resulting from contact with diesel fuel oil and lubricating oils in the monthly inspection and servicing of defendant’s diesel locomotives. A jury returned separate verdicts in favor of each plaintiff, assessing Crowley’s damages at $42,800, Kern’s at $28,900 and Criche’s at $19,500.
