Haymond, Judge:
Sometime before noon on June 6, 1945, Russell Ferguson, a young unmarried man twenty four years of age, while engaged in placing a machine for use in drilling a well for water on land occupied by Lowell Sellards in Wayne County, was instantly killed by an electric shock when a part of the metallic equipment with which he was working came in contact with a high tension wire suspended above the location of the machine.
