The State charged Appellant Clyde Newton Settles in a two-count indictment with the offenses of burglary of a building and arson. See Tex. Penal Code Ann. §§ 28.02(a)(2)(D), 30.02(a)(3) (Vernon 1994). A jury convicted him of both offenses. Two prior felony convictions enhanced Settles' punishment to the level of a habitual offender.
