Before the court is Plaintiffs Renewed Motion for Summary Judgment (Doc. # 55), filed on January 17, 2013 and Plaintiffs Motion to Strike (Doc. # 100), filed on April 23, 2013. The Motion for Summary *1211Judgment has been fully briefed (See Docs. #89, #90, #93, #98, #99) and was deemed submitted without oral argument on April 23, 2013. For the reasons outlined below, the Motion for Summary Judgment is due to be granted in part and denied in part. Plaintiffs Motion to Strike is due to be terminated as moot.1
