—Appeal by the defendant from a judgment of the Supreme Court, Kings County (Fertig, J., at trial; Koch, J., at sentence), rendered January 14, 1992, convicting him of robbery in the third degree, grand larceny in the fourth degree (two counts), and criminal possession of stolen property in the fifth degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is reversed, on the law, count one of the indictment charging the defendant with robbery in the third degree is dismissed, and the matter is remitted to the Supreme Court, Kings County, for a new trial on the remaining…
