The information in this case charged that Frank Newman did, in Creek county, on or about the 21st day of February, 1922, commit the crime of burglary in the second degree, by breaking, in the nighttime, into the store building of J. F. Cadenhead, in the town of Olive, with a felonious intent to steal certain property from the building. On the trial the jury returned a verdict, finding him guilty, and fixing his punishment at imprisonment in the penitentiary for the term of two years.
