MEMORANDUM OPINION AND ORDER

SACHS, District Judge.

The above-captioned cause is brought by the Equal Employment Opportunity Commission, pursuant to Title VII, 42 U.S.C. § 2000e et seq., alleging racially discriminatory discharge of the intervenor and a pattern and practice of racially discriminatory hiring. The intervenor, Mario Fort, was hired on the date of his application, October 13, 1972, Plaintiff’s Exh. 1, for the position of mail clerk for defendant starting October 16, 1972.
