Error to a judgment of the Law and Equity Court of the ■city of Richmond in an action of trespass on the case. Judgment for plaintiff. Defendant appeals. The opinion states the case.

This action was brought by W. A. Cheatwood against the city of Richmond for damages resulting to his property from an overflow of Shockoe creek, a natural watercourse-flowing through the city. There was a verdict and judgment below in favor of Cheatwood, and the city brings, the case here upon a writ of error.

The evidence was voluminous, and we cannot undertake-to set it out in very great detail. For the purposes of this, opinion it will suffice to say that from the standpoint of the-plaintiff, and as supporting the verdict, the evidence either…
