The plaintiff was injured about three o’clock in the morning of May 6, 1913, by falling over a stake about two inches square, which projected three or four inches above the sidewalk on Village Street, a private way running from Dane to Vine streets in the city of Somerville. Under a decree of the Superior *413Court the first named defendant, hereinafter called the railroad, was ordered to abolish a grade crossing. St. 1906, c. 463, Part I, §§ 29,45.
