MEMORANDUM-DECISION AND ORDER
McCURN, District Judge.
Plaintiff, Dennis Goetz, brings this action pursuant to 42 U.S.C. § 1983, alleging that defendants deprived him of property and liberty interests without due process of law by terminating his employment, stigmatizing him in the process, without conducting a pre-termination hearing. Presently before this court is a motion by defendant John Hogan, attorney for the defendant Windsor Central School District, seeking both dismissal of the complaint as to him pursuant to Fed.R.Civ.P. 12(b)(6) and attor ney's fees pursuant to 42 U.S.C. § 1988.
