The appellant on the 26th of March, 1872, executed and passed to Cyrus M. Gardiner, his promissory note for $394.57, payable sixty days after date, for value received, *262which Gardiner immediately assigned to the appellees. At the same time and place, he also executed a power of attorney (dated May 29th, 1872, when the note would mature) authorizing John J. Yellott, an attorney at law, to appear for him in a case to be docketed by consent, in the Circuit Court for Baltimore County, and confess judgment for the amount of this note, with interest and costs in favor of the appellees, and to do all…
