Mrs. Scott sued W. H. Scott for divorce. In the accompanying dispute over their property, Mrs. Scott made Herman Cohrs a party. After Mrs. Scott had concluded the presentation of her evidence against Scott and Cohrs jointly, the court announced that he would instruct the jury to find for Cohrs. By agreement, Mrs. Scott’s cause of action against Cohrs was severed from that asserted against Mr. Scott, and separate judgments were subsequently entered.
