1Opinion of the CourtNadeau, J.

On May 28, 2002, the Supreme Court Committee on Professional Conduct (committee) filed a petition with this court requesting that the respondent, Timothy A. O’Meara, be publicly censured for violation of certain rules of professional conduct. We referred the petition to a Judicial Referee (Bean, J.) for a hearing. The referee found by clear and convincing evidence that the respondent violated New Hampshire Rules of Professional Conduct 3.1, 3.3(a)(1), 8.4(a) and 8.4(c) *158and recommended public censure. We agree with the referee’s recommendation.
