SWAN, Circuit Judge:

This is an action brought by a Cuban corporation against an Ohio corporation whose principal place of business is in the City of New York. The action is based on contracts relating to the' distribution in Cuba of motion pictures produced by the defendant, and the relief sought includes specific performance, reformation and damages. However, the character of the action is immaterial to the issues presented by the appeal.
