MEMORANDUM OPINION

NORMA HOLLOWAY JOHNSON, District Judge.

Defendant The National Labor Relations Board has moved the Court to dismiss the instant action on grounds of mootness. Plaintiffs do not oppose the motion to dismiss, but have filed a motion for costs and attorneys’ fees pursuant to 28 U.S.C.S. § 2412 (Law.Co-op.Supp.1982), which codifies portions of the recently enacted Equal Access To Justice Act, Pub.L.No. 96-481, Title II, 94 Stat. 2325 (1980), effective October 1, 1981.
