WALLACE, Circuit Judge.

The bill of complaint in this cause was filed against the executors of Marshall O. Roberts, deceased, to recover the value of 10 mortgage bonds, for $1,000 each, made November 10, I860, by the Florida Railroad Company, and purchased by the complainant in August, 1868. The bill alleges that Roberts was a trustee for the complainant, and did willfully and fraudulently, and with intent to cheat and defraud the complainant, omit and neglect to cause the mortgage securing the bonds to be recorded, and that in consequence thereof the bonds' became worthless.
