TURGEON, J,

On December 21, 1995, plaintiff/petitioner Mary Gaster filed a petition for contempt against defendant/respondent Edwin Gaster due to his failure to pay for the college expenses of the parties’ daughter Cybil in accordance with the terms of a marital settlement agreement. Defendant thereafter filed an answer to the petition with a counter petition for contempt arguing that his ex-wife and daughter had excluded him from the process of choosing a college in violation of the terms of the marital settlement agreement. A hearing on the matter was held before me on March 4, 1996…
