Affirming.

Arnold Clift, Perry Marion and Roy Hale were in- dieted for the murder of Mrs. Reed Taylor. The indictment charges appellant with the homicide and the others .as being accessories. The counts are so drawn as to charge one or the other of the two companions as having- committed the- murder, appellant being accessory thereto.

Motions for separate trials were sustained. Perry Marion was' first tried and found guilty. On the call of the indictment against appellant both parties announced ready. Defendant waived arraignment and entered a plea of…
