Introduction

Before the Court are cross motions for summary judgment as to the Plaintiffs’ claims under the Truth in Lending Act (TILA) 1 and the Real Estate Settlement Procedures Act (RESPA). 2 Homeside alone seeks summary judgment on the Plaintiffs’ claim under the Pennsylvania Unfair Trade Practices and Consumer Protection Law (UDAP). 3 A hearing on the motions was held on February 25, 2003 at which the Court heard oral argument and then took the matter under advisement.
