MEMORANDUM

JOAN N. FEENEY, Bankruptcy Judge.

I. INTRODUCTION

The matter before the Court in this adversary proceeding is the defendant’s motion to dismiss the plaintiffs Complaint pursuant to Fed.R.Bankr.P. 7012 and Fed.R.Civ.P. 12(b)(6) for failure to state a claim upon which relief can be granted. The plaintiff filed an opposition to the motion, and the Court held a hearing on September 7, 1995. At the conclusion of the hearing, the Court ordered the parties to file supplemental briefs by September 22, 1995, at which time the motion to dismiss would be treated as a motion for summary judgment…
