Plaintiff brought this action against S. A. Zimmerman and E. B. Crosby to recover damages for alleged malpractice in the diagnosis and treatment of plaintiff’s left shoulder and arm which had been injured in an automobile accident. Upon a former trial the action was dismissed as to the defendant Crosby and a verdict returned against the defendant Zimmerman for $12,000 (Halverson v. Zimmerman, 56 N. D. 607, 609, 218 N. W. 862). This verdict was set aside by the trial court and a new trial ordered on the ground that excessive damages appeared to have been given by the jury under the influence…
