The appellant was jointly indicted with others, and convicted of robbery. He alone appeals, upon various grounds, which will appear in the course of this opinion.

On the morning of the 5th November, 1870, the cars of the Central Pacific Railroad Company of California were stopped in Washoe County, in the State of Nevada, by the defendants named in the indictment other than the • appellant, and the treasure-box of Wells, Fargo & Co. broken open and robbed of $40,000.
