The respondent commenced an action in the court below against the appellants, to recover the possession of two hundred and six sacks of wheat, containing about four hundred and twenty-five bushels, marked “ J. R. F. & Co. P.,” *418alleged to have been wrongfully taken and detained from him, and in which he had a special property to the extent of one hundred and six dollars, which was less than the value of the wheat so taken.
