Defendant makes three arguments in his motion to set aside the verdict pursuant to CPL 330.30. For the reasons outlined below, the court rejects each of the defendant’s arguments and therefore denies defendant’s motion.(1) First, defendant argues that he was denied due process of law by the prosecution’s failure to record, preserve and disclose the substance of the conversation with defendant which, according to the testimony of the other participant, the State Police investigator who was wired for sound at the time of the transaction, resulted in…
