This action was commenced by J. H. Fuss, plaintiff in error, hereinafter referred to as plaintiff, in the justice court in the town of Medford, Okla., on January .12, 1921, against the defendant in error,. Lee Anderson, hereinafter referred to as the defendant.

The plaintiff in his bill of particulars claimed the sum of 8199.23, which he alleged was due him for goods, wares, and merchandise bought of said plaintiff and delivered to said defendant ac his special instance and request.
