This case presents error from the county court of Cherokee county. The case was tried in a justice of the peace court. A bill of exceptionst was allowed by the justice, and the same was filed in the county court December 6, 1909. The county court, on motion, dismissed the case, on the ground that it did not have jurisdiction, as no appeal had been taken as provided by law.
