Marvin it. Bates and W. H. Mitchell were indicted by the grand jury at the August, 1938, term of the Circuit Court of Lauderdale county, for promoting and carrying on “a lottery for lawful money of the United States of America to be drawn and adventured for, and did then and there, by means of said lottery ... so put up, carried on, promoted and conducted unlawfully, willfully and feloniously dispose of lawful money of the United States, and in amounts and values to the grand jury unknown,” etc. The defendant, Bates moved to quash the indictment so found, on the ground that he was compelled…
