(dissenting).—On the 21st-day of October, 1893, the plaintiff, who was then a very bright and intelligent boy nine years old, got upon the lower step of the platform of one of the defendant’s street cars as it started, for the purpose of “ stealing ” a ride, holding on to the dashboard of the car with his right hand, and holding in his left hand a handle affixed to the front end of the body of the car at the side where- he stood.
