(after stating the facts). It will be noted that in the original judgment Tobe Davis pleaded guilty to the charge of selling intoxicating liquors in violation of law, and the court fixed his punishment at one year in the State penitentiary. Tt was ordered that Davis be remanded to the custody of the sheriff, and by him transported to the' State penitentiary to be there confined for a period of one year.
