KILKENNY, District Judge.
This litigation grows out of the financial difficulties of Sig Andersson in connection with the construction of segments of highways in Coos County, Oregon.
Andersson was engaged in the highway construction business and in the year 1961 agreed to construct said segments. As part of said agreements the plaintiff, as surety, and Andersson, as principal, executed and delivered certain surety bonds in compliance with state and federal law.
