This is an appeal by the plaintiff, D. D. Kennedy, Inc., from an Order of the Circuit Court of Menard County sustaining the motion of the defendant, Lake Petersburg Association, to strike the amended complaint, striking the same, and entering a final judgment for the defendant, the plaintiff having elected to stand on its amended complaint.
