This is an appeal from a judgment of sentence entered in the Court of Common Pleas of Cameron County. We affirm in part and vacate in part.

Appellant Steven James Michuck was convicted of driving under the influence of alcohol, in violation of 75 Pa.C.S.A. § 3731(a)(5)(i) (driving while blood alcohol content (BAC) is above .10% within three hours after driving, operating or having actual physical control of the vehicle) and 75 Pa.C.S.A. § 3731(a)(1) (under the influence to a degree rendering one incapable of safe driving).
