Petitioner, Caristo Construction Corp. (hereinafter referred to as “ Caristo ”) has instituted an article 78 (Civ. Prac. Act) proceeding for an order against respondents, members of the Board of Education of the City of New York, and respondent Joseph R. Weiss, as Deputy Superintendent of Schools of the City of New York and Superintendent of Plant Design and Construction of the Board of Education, directing them to deliver plans and specifications to petitioner for the purpose of permitting petitioner to prepare a bid for the construction of Public School No. 154.
