Appeal from a judgment of the Monroe County Court (John *1586R. Schwartz, A.J.), rendered November 10, 2008. The judgment convicted defendant, upon a jury verdict, of burglary in the first degree and sodomy in the first degree.

It is hereby ordered that the judgment so appealed from is unanimously affirmed.
