This is a suit for damages on account of personal injuries alleged to have resulted from an unlawful assault and battery. Mrs. Rettie Plenderson, as plaintiff below, sued all of the other parties to this record as defendants. A judgment was rendered against all. of them, except Guy E. Me- Candless, and he is brought into this appeal as a defendant in error.
