This is an appeal from a judgment order of the United States District Court for the Southern District of New York, Motley, J., entered upon a verdict of a jury convicting appellant Check, following a seven-day jury trial, on all counts of a three-count indictment charging him with two counts of possession of heroin with intent to distribute the drug, with each of the two counts also alleging an actual distribution of the drug, in violation of 21 U.S.C. § 841(a)(1) and with one count of conspiracy to distribute narcotic-drug, controlled substances in violation of 21…
