Appeal by the defendant, Charles E. Angle, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Monroe on the 12th day of December, 1898, upon the decision of the court rendered after a trial before-the court without a jury at the Monroe Trial Term.

Appellant, prior to May 19, 1894, became the owner of sixty-five shares of the capital stock of the Traders’ Bank of Tacoma, of the. par value of $100 each. The bank became insolvent in 1894 and' proceedings were instituted in the Superior Court of Pierce county,, a court of general jurisdiction in the State of Washington, for the appointment of a receiver to wind up the corporation pursuant to the laws of that State.
