ORDER GRANTING SUMMARY JUDGMENT
DAUGHERTY, District Judge.
The Court has under consideration Defendant’s Motion for Summary Judgment. Plaintiffs’ Complaint alleges that the Defendant has violated the implied covenant to diligently develop the premises covered by an oil and gas lease which was entered into by Plaintiffs and Defendant on October 31, 1961, for a term of five years and as long thereafter as oil and gas is produced. One producing well on the premises holds the entire lease. There is no offset drainage and that implied covenant is not involved herein. The relief prayed for by the…
