Presently before this Court is Defendant, Collateral Adjustment Corporation’s *274(“Defendant CAC”) Motion to Dismiss and Strike Portions of Plaintiffs Complaint, and the Response in Opposition by Plaintiff, Elizabeth Rivera (“Plaintiff’). For the reasons set forth below, this Motion is granted.
I. BACKGROUND
