TIPTON, J.-
-The respondent was indicted for perjury in the Circuit Court of the City of St. Louis. His demurrer to the indictment was sustained by the trial court and the State has duly appealed from that ruling.
The substance of the indictment alleges that on November 16, 1936, there was pending in that court the case of State of Missouri v.
