These actions, by stipulation consolidated here and in the lower court, arose out of an automobile collision in which a boy, about thirteen years of age, named Frank Peters, was injured. The accident occurred on one of the main streets of the City of Astoria in the afternoon of August 13, 1924. The boy was standing on or near the tail-gate of a Bodge truck operated by Johnson & Morrison, a co-partnership engaged in the retail grocery business.
