Appeal and cross appeal from a judgment of the Supreme Court, Oneida County (Anthony F. Shaheen, J.), entered April 21, 2004 in a personal injury action. The judgment, upon a jury-verdict, awarded plaintiff $76,708, together with interest, costs and disbursements.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously modified on the law by granting the cross motion in its entirety and as modified the judgment is affirmed without costs, and the matter is remitted to Supreme Court, Oneida County, for further proceedings in accordance with the following…
