STATON, P.J. —

T. Brooks Brademas filed a complaint in three paragraphs. Two of those paragraphs are relevant to this appeal. Paragraph I sought injunctive relief and damages resulting from an alleged continuing trespass. Paragraph II sought a declaratory judgment concerning the rights and duties of the parties herein under a deed given pursuant to a contract for the sale of certain real estate.
