Appeal from an order of the Supreme Court (Cobb, J.), entered September 17, 2001 in Greene County, which granted defendant’s motion for summary judgment dismissing the complaint.

Plaintiff is the executor of the estate of her son, Brent Wallace, who died as a result of injuries sustained in a March 1997 motor vehicle accident on State Route 81 in the Town of Coxsackie, Greene County.
