Appeal from Dade Circuit Court. — TIon. J. D. Parkinson, Judge. The testimony of Nathaniel Bray on behalf of plaintiff was as follows : . I did know of the suit of Bank against Eerguson and Stephens. I was employed by Stephens to defend the case. My impression is I examined the papers before the court convened; I know I did early in the re turn term of the suit. McAfee and Phelps and I examined the papers at that time; they represented Eerguson and Stephens.

This is an action of ejectment for an undivided half of the south half of the northwest quarter and the north half of the southwest quarter, and the southwest *682quarter of the southwest quarter of section 6, township 32, range 28, and the east half of the southeast quarter, and the south half of the northeast quarter of section 1, township 32, range 29, in the county of Dade. John N. Eerguson is the common source of title.
