SANBORN, Circuit Judge.
On July 22, 1905, F. J. Tygard, as principal, and John C. Hayes, J. M. Catterlin, and Thomas J. Smith, as sureties, gave to the Bates National Bank of Butler; Mo., a bond in the sum of $10,000 conditioned that Tygard, who was the president of that bank, should faithfully discharge the duties of his office “during the legal term of said office,” and that he should account for all funds which should come to his hands as such president. .Tygard was elected president on January 10, 1905, and again on January 15, 1906, in accordance with the provisions of the articles of…
