This is an appeal from a judgment obtained by a peremptory instruction in favor of appellees. The ■action was brought by appellant for the recovery of damages for personal injuries received by him while at • work widening a tunnel about two thousand feet long and • situated about ten miles south of the city of Covington on the L. & N. E. E.
